The short version. Atomic VPN is a subscription service run by AtomicMail Systems OÜ in Estonia. Use it for anything lawful, keep your account to yourself, and pay for the plan you chose. We keep the service running and keep no record of what you do while connected.

These terms say what you can expect from us, what we expect from you, how subscriptions renew and end, and what happens if something goes wrong. Nothing here takes away the consumer rights your own country gives you.

1. About these terms

These Terms of Use are the agreement between you and AtomicMail Systems OÜ, a company registered in Estonia at Harju maakond, Tallinn, Kesklinna linnaosa, Harju tn 3 (“Atomic VPN”, “we”, “us”). They cover the VPN service, our applications for every platform we publish on, our browser extensions, the account pages at auth.atomicvpn.io and the website at atomicvpn.io.

You accept these terms by creating an account or by using the service. If you do not accept them, do not use Atomic VPN. Our Privacy Policy forms part of this agreement and explains what we do and do not collect.

If you are using Atomic VPN as a consumer, the mandatory consumer-protection rules of the country you live in apply on top of these terms, and nothing here limits them.

2. Who may use Atomic VPN

Give accurate details when you sign up, keep your password and any sign-in codes to yourself, and tell us promptly if you think someone else has access. You are responsible for activity under your account, except where it results from our own failure.

Each plan includes a number of devices that may use the service at the same time; the current number is shown on the pricing page and on your account page, where you can also sign devices out. Do not share, sell, rent or sublicense your account, and do not work around the device limit.

Because we keep no record of what you do while connected, we cannot restore anything from your side of the service, and we cannot identify you from network activity. That is by design.

4. The service

We provide access to our VPN network, the apps that connect to it, and the features described on our website and in the store listings for the plan you hold. We work to keep the service available and fast, but we do not promise that it will be uninterrupted or error-free, that any particular server, country or protocol will always be available, or that you will reach any particular speed — speed depends on your own connection, your distance from the server, and the networks in between.

We may add, change or withdraw features, servers and locations. If a change materially reduces what your paid plan offers, we will tell you in advance and you may cancel and receive a refund of the unused part of your term; if you subscribed in a store, section 7 explains where that refund comes from. We may also suspend the service temporarily for maintenance, security or legal reasons, and will keep those interruptions as short as we reasonably can.

A VPN protects the connection between your device and our servers. It does not make you anonymous, it does not secure the sites and services you use afterwards, it does not replace antivirus software, and it does not put you beyond the reach of the law.

5. Acceptable use

Use Atomic VPN for anything lawful. Lawful peer-to-peer and file sharing is fine; the traffic below is not, and it is what will get an account closed:

We enforce this without inspecting your traffic — we cannot see it. We act on what reaches us from outside: abuse reports, network-level signals such as sustained traffic patterns that harm other users, and lawful complaints. Where we can, we contact you first. Serious cases, and anything that endangers the network or other users, may lead to immediate suspension or termination under section 11.

6. Plans, payment and renewal

Current plans, terms and prices are shown on our pricing page and in the app stores. Prices include or exclude tax as stated at checkout, and any tax we are required to collect is added there. We may offer a free tier with limited functionality; free access comes with no commitment on either side and may change at any time.

Subscriptions renew automatically for the same period at the price then in force, until you cancel. Where you cancel and how depends on where you bought:

For store purchases, the charge is taken by the store within the 24 hours before the current period ends, and turning off auto-renewal there is the only way to stop it — deleting the app, or deleting your Atomic VPN account, does not cancel a store subscription.

If we change the price of a plan you hold, we will tell you at least 30 days in advance, and the new price applies only from your next renewal, so you can cancel first. If a payment fails, we may retry it and may suspend premium access until it succeeds.

7. Cancelling, refunds and withdrawal

You can cancel at any time. Cancelling stops the next renewal; your plan keeps working until the end of the period you already paid for, and we do not pro-rate a term you chose to end early, except where the law or the sections below say otherwise.

Purchases made in the App Store or Google Play are refunded by Apple or Google under their own policies, not by us. We cannot issue a refund for money we never received.

Purchases made directly from us: if you are a consumer in the European Economic Area or the United Kingdom, you have 14 days from the start of your subscription to withdraw from the contract. Because a VPN starts working immediately, you ask us to begin performance right away when you connect; if you then withdraw, we refund what you paid less a proportionate amount for the part of the period already served. Write to [email protected] within those 14 days and we will process it within 14 days of receiving your request, using the same payment method you used.

Where these terms promise a refund of the unused part of your term and you subscribed through Apple or Google, that money can only come back from the store, and we will support your request to them. Outside those cases, we will still refund you where the service was materially not what we described, or where the law where you live requires it.

8. Your privacy

How we handle personal data is set out in full in our Privacy Policy, which is part of this agreement. In short: we do not log your browsing history, the contents of your traffic, your DNS queries or the addresses you were given, and we do not sell, use or disclose data collected through the VPN service to third parties for any purpose. The account layer — your email address, your subscription and your devices — is the only part of you we hold.

9. Licence to use our software

We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to install and use our applications and extensions on devices you own or control, for as long as your account is in good standing, and only to use the service as these terms allow.

You may not copy, modify, translate, rent, lease, sell, sublicense or distribute our software, remove its notices, or reverse-engineer, decompile or disassemble it — except to the extent that applicable law gives you that right and forbids us to prevent it. Our software includes third-party open-source components; where an open-source licence grants you more than this section does, that licence governs those components, and the notices in the app tell you which they are.

Updates may be delivered automatically, including security fixes; running an outdated version may leave features or the connection itself unable to work.

10. Our intellectual property

The service, our software, our website, the Atomic VPN name and our logos belong to us or to our licensors and are protected by intellectual-property law. These terms give you the right to use the service, and nothing else. Feedback you send us we may use freely, without obligation to you and without it becoming confidential.

11. Suspension and termination

You may stop using Atomic VPN whenever you like, and delete your account on your account page, in the app where your version offers it, or by writing to [email protected]the Privacy Policy explains exactly what deletion removes.

We may suspend or terminate an account if it breaches section 5, if payment fails and is not resolved, if we are legally required to, or if keeping it open would endanger the service or other users. Except where the breach is serious or immediate action is needed, we will warn you first and give you a chance to put it right. If we terminate your account for a reason that is not your fault, we refund the unused part of your term, subject to section 7 for purchases made in a store; if we terminate it for a serious breach, we do not.

We may also discontinue the service as a whole. If we do, we will give at least 30 days' notice and refund the unused part of any term you have paid for, again through the store where the store took the payment.

12. Disclaimers

Beyond what these terms and the law promise, the service is provided as it is and as available. We do not warrant that it will meet a particular purpose of yours, that it will be free of interruption or error, that any location or protocol will be reachable at a given moment, or that using it will keep you private from parties who already know who you are — the sites you sign in to, the software on your device, and anyone watching your device itself.

If you are a consumer, this section applies only as far as the law allows: your statutory rights, including rights to a service performed with reasonable care and matching its description, are not affected.

13. Liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or intent, or for anything else that cannot be limited by law.

Subject to that, we are not liable for indirect or consequential loss, for lost profits, revenue, business or data, or for loss you could have avoided by following these terms or by taking reasonable care — and our total liability arising out of the service in any 12-month period is limited to the amount you paid us for the service in that period.

If you are a consumer, we are liable for foreseeable loss caused by our failure to meet these terms, and this section limits our liability only so far as consumer law permits.

14. Changes to these terms

We may change these terms — for example when we add features, change how billing works, or the law changes. We will publish the new version here and update the date at the top. For changes that materially affect you, we will give notice by email or in the app at least 30 days before they take effect, and you may cancel before then if you do not accept them. Continuing to use the service after a change takes effect means you accept it.

15. Governing law and disputes

These terms are governed by Estonian law. If you are a consumer, this choice does not deprive you of the protection of the mandatory rules of the country you live in, and you may bring proceedings in your own country's courts.

Talk to us first: most problems are settled faster by email than by anything else. If we cannot resolve it, consumers in Estonia may take the matter to the Consumer Disputes Committee at the Consumer Protection and Technical Regulatory Authority; consumers elsewhere in the European Union can find their national body through the European Consumer Centre network. Otherwise, disputes are heard by the courts of Estonia.

Where you download our app from the App Store or subscribe inside it, the following also applies, and Apple requires us to say it plainly:

Where you download our app from Google Play or subscribe inside it, Google Play's terms apply alongside these, Google takes the payment and handles refunds under its own policies, and subscriptions are managed and cancelled in Google Play. Google is not a party to this agreement and is not responsible for the app or the service.
